Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Critical Power (the "Service"), operated by Boathouse Fitness ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
Critical Power is a web-based tool that calculates your Critical Power, W′, training zones and training sessions from ergometer test data you provide. It is intended as a training aid for rowers and coaches.
Not medical advice. Critical Power is not a medical device. The information we provide is for training purposes only and should not be used for medical diagnosis or treatment. Always consult a qualified health professional before starting any new training programme.
2. Eligibility
You must be at least 16 years old to create an account. If you are between 13 and 16, you may only use the Service with verified parental or guardian consent. The Service is not available to children under 13.
3. Accounts
You are responsible for keeping your account login credentials secure and for all activity that happens on your account. Let us know immediately if you believe your account has been accessed without your permission.
4. Your data, your responsibility
You are responsible for the accuracy of the data you enter into the Service. Our calculations are only as reliable as the test data you provide. Critical Power relies on honest, well-executed ergometer efforts to produce meaningful results.
5. Subscription plans and payment
Paid subscriptions are billed annually in advance. Pay-per-report purchases are one-off payments. All payments are processed by Stripe.
You can cancel your subscription at any time from your account. Cancellation takes effect at the end of the current billing period, and you will not be charged again. Annual subscription fees are non-refundable outside of the statutory cooling-off period described below.
6. Cooling-off period (UK and EU consumers)
If you live in the UK or EU, you have a statutory right to cancel your purchase within 14 days of signing up, for any reason. To exercise this right, contact us at boathouse@strengthconditioning.academy. By using the Service during the cooling-off period, you agree that we may begin providing the Service immediately, and you may lose the right to cancel once the Service has been substantially delivered.
7. Acceptable use
You agree not to:
- Use the Service in any way that breaks the law
- Reverse engineer, copy or attempt to extract our source code
- Try to bypass paid features, share one account across a team, or run multiple athletes through a single-user plan
- Interfere with or disrupt the Service or its security
- Use automated tools to scrape data from the Service
- Impersonate another person or misrepresent your identity
8. Intellectual property
The Service, including its code, design, text, graphics and the Critical Power calculation model as we implement it, is owned by Boathouse Fitness and protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service for your personal or organisational training needs, according to your subscription plan.
Your own test data and profile remain yours. You grant us a licence to use it as described in our Privacy Policy.
9. Service availability
We aim to keep the Service available around the clock, but we cannot guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or emergency fixes, and will give reasonable notice where possible.
10. Limitation of liability
To the maximum extent permitted by law, Boathouse Fitness is not liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
11. Termination
You can close your account at any time. We may suspend or terminate your account if you breach these Terms, abuse the Service, or if we are required to by law.
12. Changes to these Terms
We may update these Terms from time to time. If the changes are material, we will notify you by email or with a prominent notice on the Service before the changes take effect.
13. Governing law
These Terms are governed by the laws of England and Wales. Any dispute arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, unless you are a consumer in the UK or EU, in which case you may bring proceedings in the courts of the country where you live.
